1. Agreement to Terms
By accessing and using Scolemax Webhosting services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our services.
These Terms apply to all visitors, users, and others who access or use our Services, including but not limited to web hosting, domain registration, data center services, software development, and related services.
2. Services Provided
Scolemax provides the following services:
- Web Hosting: Shared hosting, VPS hosting, reseller hosting, and dedicated server solutions
- Domain Registration: Domain name registration and management services
- Data Center Services: Colocation, infrastructure hosting, and managed services
- Software Development: Custom web and mobile application development
- Digital Services: Website management, AdSense setup, and related services
- Hardware Sales: Computer hardware and storage equipment
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to customers.
3. User Accounts
Account Registration: You must provide accurate, complete, and current information during the registration process. You are responsible for maintaining the confidentiality of your account credentials.
Account Security: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account or any other breach of security.
Account Eligibility: You must be at least 18 years old to create an account and use our services. By creating an account, you represent that you meet this age requirement.
4. Acceptable Use Policy
You agree NOT to use our services for:
- Any illegal activities or content that violates Kenyan or international laws
- Distributing malware, viruses, or any malicious code
- Sending unsolicited bulk emails (spam) or engaging in phishing activities
- Hosting or distributing copyrighted material without proper authorization
- Adult content, gambling, or any content prohibited by Kenyan law
- Activities that compromise network security or attempt unauthorized access
- Resource-intensive processes that negatively impact server performance
- Fraudulent activities or identity theft
Violation of this policy may result in immediate suspension or termination of services without refund.
5. Payment Terms
Billing: Services are billed in advance on a monthly, quarterly, semi-annual, or annual basis as selected during purchase.
Payment Methods: We accept M-PESA, Visa, Mastercard, and other approved payment methods. All prices are in Kenyan Shillings (KSh) unless otherwise stated.
Automatic Renewal: Services automatically renew at the end of each billing period unless you cancel before the renewal date.
Late Payments: Accounts with overdue invoices may be suspended. A late fee of 5% per month may be applied to overdue balances.
Price Changes: We reserve the right to change prices with 30 days' notice. Existing customers will be notified via email.
6. Refund Policy
30-Day Money-Back Guarantee: We offer a 30-day money-back guarantee on shared hosting and VPS hosting plans. If you're not satisfied, request a refund within 30 days of your initial purchase.
Exclusions: The following are NOT eligible for refunds:
- Domain name registrations and renewals
- Dedicated servers
- Setup fees and add-on services
- Software development services
- Accounts terminated for Terms of Service violations
Refunds are processed to the original payment method within 7-14 business days.
7. Uptime Guarantee
We guarantee 99.9% uptime for our hosting services (excluding scheduled maintenance). If we fail to meet this guarantee, you may be eligible for service credits as follows:
- 99.0% - 99.8% uptime: 5% service credit
- 98.0% - 98.9% uptime: 10% service credit
- Below 98.0% uptime: 25% service credit
Service credits must be requested within 7 days of the incident and are limited to one month of service fees.
Exclusions: Downtime caused by factors outside our control, including DDoS attacks, network carrier issues, or scheduled maintenance, is not covered by this guarantee.
8. Data & Privacy
Data Backup: While we perform regular backups, you are responsible for maintaining your own backups. We are not liable for data loss.
Data Security: We implement industry-standard security measures to protect your data. However, no system is 100% secure.
Privacy: Your use of our services is also governed by our Privacy Policy. Please review it carefully.
Data Location: Your data is stored in our data center in Matete, Kakamega, Kenya, and is subject to Kenyan data protection laws.
9. Intellectual Property
Your Content: You retain all rights to content you upload to our servers. You grant us a license to store and display your content as necessary to provide our services.
Our Property: The Scolemax name, logo, and all related materials are our intellectual property. You may not use them without our written permission.
Software Licenses: Any software provided as part of our services is licensed, not sold, and is subject to applicable license agreements.
10. Termination
By You: You may cancel your services at any time through your account dashboard or by contacting support. Cancellations take effect at the end of the current billing period.
By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or fail to pay for services.
Data Retention: Upon termination, your data may be deleted after 30 days. Please ensure you have backups before canceling.
11. Limitation of Liability
To the maximum extent permitted by law, Scolemax shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or data loss
- Actions of third parties or content posted by users
Our total liability for any claim related to our services shall not exceed the amount you paid for services in the 12 months preceding the claim.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through our website. Continued use of our services after changes constitutes acceptance of the modified Terms.
